Terms and conditions

Any monies received by Dollybrook Resort LLC for occupancy of vacation property indicated the acceptance of the terms of our vacation rental agreement in full. All policies are strictly enforced. It is the responsibility of all guests and members of their party to be familiar with all policies pertaining to rental.

GUEST VERIFICATION

I give permission to SafelyStay, Inc. to verify my identity and check criminal databases in order to confirm my reservation. Complete terms regarding Safely's guest verification can be found at www.safely.com/terms. You will receive an email from Concierge@Safely.com to complete your screening. Please check your spam folder for this email, and contact Safely at Concierge@Safely.com, or go to www.Safely.com if you have any questions.

RESPONSIBILITY OF RENTER

The person in whose name the reservation is made must be 25 years of age or older, is required to stay at the property for the duration of the rental period, and accepts full responsibility for the actions of all persons on the premises during the stay. Failure to honor this requirement will result in eviction without a refund in addition to other remedies available to the Owner. Any overnight guests in addition to those registered and in excess of the property’s capacity will result in eviction without refund. Renter agrees to be financially responsible for any damages/repairs to this rental property and /or its contents caused by the Renter or Renter’s guest/guests’ negligence or willful conduct during the rental period. Renter understands that there are special risks that may be involved in using features, i.e. spa, hot tub, Jacuzzi, whirlpool, pool, gas grills, etc., as well as using other areas of the property. Renter agrees to explain the risks of using the special feature to any guests they may have at the property and will be fully and solely responsible for any accidents and injury and indemnity as explained below. Children sleeping on the floor are a hazard to other occupants in the event an emergency exit is required.

CONDOMINIUM ASSOCIATION FORM

A Condominium Association Form (if applicable) will be sent to the Renter upon booking. These form(s) must be completed and returned to Jaqua within 7 days of booking for the reservation to be confirmed. If the forms are not returned within 7 days, the property will be released for booking by another party.

GOOD NEIGHBOR GUIDE

It is the responsibility of the Renter to become familiar with the Good Neighbor Guide for Renters located at the property. This guide outlines city ordinances for people staying at a property located within that specific city.

OCCUPANCY

Rental properties may only be used by the number of adults and children specified on the reservation. Daily visitors are allowed at the property, but under no circumstance shall the total number of occupants and guests exceed the maximum occupancy listed for the property. Occupancy and use of the premises and common areas shall not be such as to disturb or offend guests, residents, or neighbors. In the event this occupancy limit is violated, Jaqua has the prerogative to terminate this agreement and ask disruptive guests to vacate the premises.

WEDDINGS/EVENTS

No weddings, events, or parties of any kind are to be held at the property or open areas without the approval of Jaqua. An event is any gathering of people that exceeds the maximum total occupancy for the property. Failure to honor this requirement will result in eviction without a refund.

PAYMENT

Jaqua accepts payments by Visa, MasterCard, American Express, and Discover. For reservations made prior to 60 days before arrival, a deposit of 50% of the total reservation is required at the time of booking. The final 50% payment is due 60 days prior to the arrival date. Final payments will be processed automatically to the card on file. For reservations that are made less than 60 days before the arrival date, full payment is required at the time of booking to confirm the reservation.

Damage Insurance (Non-refundable)

As part of our effort to help guests relax and enjoy their stays, we have partnered with Safely.com to provide property damage protection. The cost of this protection has been included in the rental rate and fees and covers accidental damages during the stay. This coverage includes:

Up to $10,000 of accidental coverage for property and contents damage. Complete terms regarding the Trust and Safety coverage can be found at safely.com/terms. The Trust and Safety Fee is refundable only if the reservation is canceled in writing at least 60 days prior to the arrival date.

Up to $5,000 of accidental coverage for contents damage and up to $100,000 coverage for accidental property damage and bodily injury. The Trust and Safety Fee is refundable only if the reservation is canceled in writing at least 60 days prior to the arrival date.

Up to $5,000 of accidental coverage for content damage and up to $1,000,000 coverage for accidental property damage and bodily injury. The Trust and Safety Fee is refundable only if the reservation is canceled in writing at least 60 days prior to the arrival date.

CANCELLATIONS

Cancellations outside of 60 days from check-in will result in a full refund minus a $250 cancellation fee. Cancellations within 60 days of check-in will result in full forfeiture of all monies received unless the property is re-rented. If the property is re-rented for the exact time frame and at the same rate, a $250 processing fee will be charged and the balance will be refunded to the Renter. Changing a reservation from one property to another is considered a cancellation and all cancellation policies apply. Renters may wish to consider purchasing travel insurance for protection in the event of unforeseen circumstances. Renters may purchase this coverage through a personal insurance agent or through Rental Guardian as an added feature of any reservation.

ARRIVAL DATE

Check-in time is {reservations.unit_check_in_time} on the day of your arrival at the property. All our homes are equipped with an electronic lock or lock box containing a key. If the rented property is equipped with an electronic keypad, please be aware the entry code is time-stamped and will not work until 3:00 pm on the day of arrival. All guests will be contacted approximately one week prior to arrival with specific instructions, codes, maps, and check-in details.

DEPARTURE DATE

You will receive instructions for check-out procedures before your arrival. Guests are required to check out by {reservations.unit_check_out_time} in order for us to have the property ready for our next guests. The penalty for late check-out will be $100 per hour after 10:00 am, and will be charged to the credit card on file. If your home has a lockbox, please make sure the key is placed back in the lockbox. If you picked up keys at the Jaqua office, drop off keys in the drop box at the office. If your property is equipped with an electronic keypad, please be aware your entry code is time-stamped and will no longer work after 10:00 am EST on the day of your departure.

PET POLICY

For any properties with a NO PET policy, this policy will be strictly enforced and violators will be subject to immediate eviction and a $500 damage fee to be charged to the credit card on file.

NO SMOKING

For safety purposes and in consideration of the property owners/guests, smoking is prohibited in or around the rental property. Failure to honor this request will result in a $500 damage fee to be charged to the credit card on file and is subject to eviction.

NO FIREWORKS OR FIREARMS

Safety is a concern; therefore, no fireworks are permitted on the rental property and/or the beach at any time. Firearms of any kind are not allowed inside the dwelling and must at all times during your stay be stored in your vehicle in a locked storage container. Failure to honor these requirements will result in immediate eviction without a refund.

PARKING

All vehicles and license plate numbers must be registered with Jaqua at check-in. Parking is limited and may not exceed the property’s maximum allowable vehicles.

INDEMNIFICATION & HOLD HARMLESS

Prices, properties, and other specifications are subject to change without notice. In the event a reserved property subsequently becomes unavailable or uninhabitable due to circumstances beyond the control of Jaqua, a refund may be offered. Jaqua, the property owner, and any representatives involved with the management of the property shall be held harmless and indemnified by you, the Renter, from any claim, loss, expense, damage, or injury resulting from guests’ use or occupancy of the property. Jaqua Realtors will not assume responsibility for loss, delay, or expense caused by weather or other circumstances beyond the control of Jaqua Realtors.

KEYS

A $50 fee per key will be charged for lost or non-returned keys. If you lock yourself out of the property and require assistance after normal business hours, the fee will be $50.

TRAM/STAIR access keys – A $250 fee will be charged for lost or non-returned keys at applicable properties.

REPAIRS

Emergency contact information will be provided in all the rental units. It is imperative the Jaqua Realtors staff be contacted in all emergency situations. Every effort will be made to keep appliances, etc. in good repair. Air conditioners, televisions, and appliances cannot be guaranteed and no refund or rate adjustment will be made for mechanical failure unless the refund is authorized by the owner. If maintenance is necessary, the problem will be addressed as soon as possible after notification by Renters.

HOUSEKEEPING

All rental properties are cleaned prior to arrival. Please maintain the property in a clean and sanitary condition at all times. It is the responsibility of the Renter to provide beach towels. Most of the rental properties have on-site laundry facilities for use. Any extra time spent by cleaners due to excessive cleaning or removal of trash/items will be charged to the guest.

RIGHT OF ENTRY

Jaqua Realtors or authorized agents may need to enter the property for the purpose of inspection, maintenance, or real estate showings. Every effort will be made to prevent any inconvenience or disruption of your vacation.

POSSESSIONS

Any personal items or property left on the premises after occupancy are not the responsibility of Jaqua. Jaqua will undertake to return such items if identified by Renter and located by Jaqua no later than 30 days from departure. The Renter is responsible for the cost of shipping plus a $25 return fee. Food items will not be returned. All personal items or property that remain unclaimed after 30 days from departure shall be deemed abandoned and disposed of by Jaqua in its sole discretion.
